TERMS & CONDITIONS

About

You agree to these Terms and Conditions if you purchase a Membership from The Gym or use any of the facilities. We may from time to time change these terms and conditions and we will give you at least thirty (30) days notice of any significant changes. An updated version of these Terms and Conditions will always be available on the website. Please read them carefully before agreeing to them.

 

Definitions used 

"The Gym": The fitness facility at Unit 3 Wessex Business Centre, Meadow Lane Westbury BA13 3EG. “The Gym” and “The Gym Westbury” are trading names of The Local Gym Company Ltd, a limited company registered in England & Wales (no: 13963158) with a registered office of the same address.

 

"The Gym Rules": The rules and regulations of The Gym as set out on the website (www.thegymwestbury.com) which may change from time to time.

 

"The App": The Gym’s application instance hosted by ClubRight.

 

"PARQ": Physical Activity Readiness Questionnaire - an industry-method of covering health and lifestyle issues prior to starting an exercise program.

 

1. Memberships

a. Prospective members must register with The Gym through the link on the website. Once completed they will be able to download and have access to The App. 

 

b. An individual is considered a Member when they have a current, paid membership. Memberships are purchased through The App and all available options are listed on the website. Membership prices may change from time to time and we will give at least thirty (30) days notice to members if this is the case. We use third parties to process our payments and are not liable for any delay or issues arising from transactions or any dispute or issue between you and those third parties.

 

c. Some Memberships may not be available on The App. If you wish to apply for a Memberships which is not available then please email us at memberships@thegymwestbury.com or speak to a member of staff. Any concessionary rates including public-sector workers or age-related discounts will require proof before a Membership is granted. This must be provided over email when requested. Failure to provide proof may lead to cancellation of your membership without refund.

 

d. Members will be granted access to The Gym and its facilities for the duration specified in the specific Membership. When the Membership expires the individual will no longer have access to The Gym or its facilities until another is purchased.

 

e. Every Member will be issued with a Membership number which is contained in the profile tile on The App (top left corner). It is unique to each Member and should be included in any correspondence between the Member and The Gym.

 

f. Members aged under 16 are only eligible for the "Under 16" membership plan. All members aged under 16 will be subject to the following restrictions:

  • They are only permitted to be in The Gym during the following times:

    • Weekdays: 0600-0800, 1500-1715 and 1930-2100

    • Weekends: 1600-1800

 

  • Outside of these hours they will be allowed to enter The Gym if accompanied by an adult Member aged 18 and over. The adult Member will need to inform of of the intention to do this in advance by emailing us at memberships@thegymwestbury.com. If it is intended to be a regular occurrence then they will only have to only let us know once. 

 

  • They will receive a mandatory induction in the use of free weights and gym equipment and they agree to accept the advice and guidance in safe gym use from members of staff and/or nominated senior gym users.

 

  • They agree to demonstrate their adherence to the Gym Rules outlined below and accept they may be in breach of these Terms and Conditions if they do not.

 

2. Cancelling membership

a. If you have a genuine medical condition which prevents you from using any service you have already paid for then please contact us at memberships@thegymwestbury.com. We will consider your circumstances and may, on receipt of appropriate evidence, offer a reasonable refund. We reserve the right not to refund any Membership after payment has been made.

 

b. Monthly Memberships purchased through The App will automatically convert to a “rolling monthly payment” unless they are cancelled. You may cancel a rolling monthly Membership at any time by sending an email to memberships@thegymwestbury.com quoting your membership number and clearly requesting the next payment be cancelled. Your email should be sent to us at least seven (7) working days before the payment is due. Any emails received after 1730 will be deemed to have been received on the following day.

 

c. We reserve the right to cancel a Membership without refund and subsequently to refuse entry to the Gym for any individual should they:

 

  • Break any of these Terms and Conditions

  • Put the health, safety or well being of staff or other members’ at risk

  • Engage in any disruptive, violent or abusive behaviour

  • Intentionally facilitate the entry of another individual into The Gym against the terms of this agreement

  • Intentionally enter The Gym without correct use of the QR code on the App.

 

3. Access to The Gym

a. Only Members will be permitted to enter The Gym. Guests are permitted provided they are hosted by a member of Staff or a nominated Associate (eg. class instructor). Anyone entering as a guest agrees to these Terms and Conditions.

 

b. The QR code on The App is needed to enter the gym. The QR code on the home screen of The App is unique to each Member. The QR code changes frequently so cannot be reused by anyone else and will need to be opened immediately prior to entering the gym (screen shots made before will not work). The QR code should be presented to the bar scanner to gain access to The Gym. To exit the gym please press the green exit button by the door.

 

c. The QR code must not be used to enable entry for anyone else. Any intentional attempt by a Member to enable entry for another person, even if that person is also a Member, will constitute a breach of these Terms and Conditions. Any intentional attempt by an individual to gain illegitimate access (eg. “tailgating” or using the fire escape) will result in a breach of these Terms and Conditions. This may result in The Gym cancelling Memberships for anyone breaching these Terms and Conditions as outlined in section 2.c.

 

4. Unmanned hours

a. The Gym will at times be unmanned - during these times no member of Staff will be on site. During these periods:

 

  • There will be recorded CCTV for members’ safety

  • You agree to have your mobile phone with you at all times

  • You must call the emergency services in the case of an emergency

  • You must call us on 07494035584 as soon as possible in the case of any accident or incident which requires our attention.

 

5. The Gym Rules

  • Kind - look out for and after others in the gym

  • Tidy - put kit away, wipe it down and don't block passageways

  • Responsible - train safely, within your capabilities and allowing for injuries

  • Safe - Look after your possessions and don't leave anything behind.

 

6. Liabilities

a. The management and its employees of The Gym will not be liable in any way for the loss, or damages to, the property of Members or guests, or for personal injury to, or death of any Member or guest, except to the extent that such loss, damage, personal injury or death arises from the initial act, neglect or default of the management or any of its employees or agents.

 

b. The Member warrants and represents that they are in good physical condition and that they know of no medical or other reason why they are not capable of engaging in active or passive exercise and that such exercise will not be detrimental to their health, safety, comfort or physical condition. In the event you or your guest has any reservations in relation to physical condition you are required to seek independent medical advice prior to embarking upon any exercise. All Members and guests agree to the PARQ statement when commencing any activities as a condition of Membership. Induction training will be available to all Members but must be requested by Members on joining. Attendance to induction training is the responsibility of all Members and their guests. Any person using the facilities without attending induction training does so entirely at their own risk.

 

c. Cars parked in the car park or elsewhere outside the club and all contents are left at the owner’s risk and The Gym will accept no liability for loss or damage in respect thereof, unless caused by negligence of the management, employees or agents of the company.

 

d. The Gym accepts no liability for personal belongings left on the premises or in lockers.  Members & guests are strongly advised not to carry or leave valuables in lockers.  In circumstances when it is necessary to carry valuables, please contact a member of staff.  Members are required to bring a padlock with them each visit, as we do not loan padlocks. Lockers are provided on a daily basis only and items left more than 3 hours will be removed from the lockers and any contents will be disposed of for security reasons.  This policy is adopted for members' safety and security.

 

e. All Members and guests are advised to make their own arrangements in respect of insurance to cover injuries suffered by them or caused by them to any third party, as the proprietors accept no liability for any accident, injury or misadventure.
